Buyer Terms

Positioning

ArtListings provides an online platform and related tools. ArtListings is not the seller of the artwork and is not a party to the sales contract between buyer and seller.

The seller is the seller of record and is solely responsible for the artwork listing, price, availability, order handling, payment, shipping, delivery, returns, refunds, complaints, and compliance with applicable law.

Acceptance Of Terms

  • By accessing, visiting, using, interacting with, creating an account on, placing an order through, sending a message through, or otherwise using ArtListings services, the user accepts these Buyer Terms to the extent legally permitted.

  • If ArtListings publishes updated Buyer Terms, continued use of the services after the effective date of the updated terms constitutes acceptance of those updated terms to the extent legally permitted.

Buyer Actions

Buy now

  • A Buy now action creates an order in the seller's name.

  • The seller receives the buyer's contact details and remains responsible for accepting, processing, and completing the order.

  • ArtListings does not become the merchant, shipper, or refunding party.

Suggest a price

  • Suggest a price is a communication and negotiation tool.

  • ArtListings does not guarantee that the seller will respond, accept, counter, or complete a transaction.

Ask the seller

  • Ask the seller is a contact and messaging tool for questions about an object, its status, or possible transaction terms.

  • ArtListings does not guarantee any response or the correctness of any answer given by a seller.

Seller offers through messaging

  • Sellers may send offers through the messaging system.

  • Such offers may include a custom artwork price and a custom shipping price.

  • If the buyer accepts such an offer, the buyer may be routed into checkout or order details based on that seller offer.

  • The offer remains the seller's offer, not an ArtListings offer.

Seller Ratings And Responsiveness

  • ArtListings may collect, calculate, use, and display seller ratings, reviews, response-time indicators, response-rate indicators, complaint signals, or similar seller-performance information.

  • Where legally and contractually permitted, this may include ratings, reviews, review counts, badges, or similar reputation signals imported or derived from Google or other third-party services relating to a seller.

  • Such information may be shown on listings, seller profiles, search results, account surfaces, emails, or other platform interfaces for transparency, ranking, trust, quality, moderation, or product purposes.

  • Such signals are informational only and do not constitute a guarantee by ArtListings regarding seller quality, reliability, identity, solvency, or transaction outcome.

Seller Responsibility

The seller is solely responsible for:

  • artwork descriptions

  • authenticity statements

  • condition

  • dimensions

  • images

  • pricing

  • stock and availability

  • shipping pricing

  • taxes and invoicing

  • order acceptance or refusal

  • shipping, delivery, export, import, and insurance

  • complaints, returns, refunds, and legal obligations toward the buyer

Seller Additional Terms

  • A seller may publish additional buyer terms, shipping terms, delivery conditions, return instructions, or similar transaction terms through its ArtListings or Artimin account, storefront, listing flow, messaging flow, or checkout-related surfaces.

  • Any such additional terms are provided by the seller, not by ArtListings, and remain solely the seller's responsibility.

  • Buyers should review seller-provided shipping terms and buyer terms carefully before placing an order or accepting an offer.

  • To the extent legally permitted, seller-provided transaction terms apply between buyer and seller alongside these platform terms, but mandatory law prevails where applicable.

Currency Conversion And Display

  • ArtListings may fetch reference exchange rates on a daily basis and may automatically convert artwork prices, offer prices, and shipping prices into another display currency for convenience.

  • Unless checkout, order details, or payment instructions expressly state a different binding payment currency, the legally relevant price is the price set by the seller in the stated transaction currency.

  • Auto-converted or displayed currency amounts may differ from the amount ultimately debited from or credited to the buyer's account due to exchange-rate movements, rate timing differences, payment-provider or bank conversion rates, fees, or rounding.

  • ArtListings is not liable for such currency conversion differences, exchange-rate fluctuations, or third-party conversion fees, except to the extent liability cannot be excluded under mandatory law.

Returns, Complaints, and Consumer Law

  • Returns, refunds, withdrawal rights, conformity, and complaints are handled directly between buyer and seller.

  • The seller must comply with the laws that apply to the transaction.

  • The buyer and seller must resolve product, delivery, and legal issues directly with each other.

  • ArtListings only provides the platform and communication tooling.

  • ArtListings may forward buyer complaints, claims, disputes, or related notices to the relevant seller for handling and follow-up.

Seller Order Refusal Or Cancellation

  • A seller may refuse, reject, or cancel a sale where legally permitted, for example because stock is incorrect, the object has already been sold, the object is lost or damaged, there is a clear pricing mistake, or there is a fraud or compliance concern.

  • Any communication, repayment, or legal follow-up remains the seller's responsibility.

Platform Scope And Changes

These terms apply to use of ArtListings services, including:

  • artlistings.com

  • www.artlistings.com

  • app.artlistings.com

  • app.artimin.com

  • related current and future products, tools, widgets, integrations, and services

ArtListings may add, change, suspend, limit, replace, or remove platform features and services at any time.

Liability Limitations

To the fullest extent permitted by law, ArtListings is not liable for:

  • incorrect, outdated, or mistyped prices

  • incorrect or outdated stock or availability information

  • incorrect offer prices or shipping prices

  • currency conversion differences, exchange-rate fluctuations, or third-party bank or payment-provider FX fees

  • seller-provided buyer terms, shipping terms, delivery conditions, return instructions, or similar supplemental transaction terms

  • seller actions or omissions

  • seller response times, non-responsiveness, poor handling, low ratings, reviews, or complaint signals

  • the seller's handling or non-handling of complaints, claims, disputes, chargebacks, or legal notices

  • scams, phishing, impersonation, forged payment evidence, fake pickup agents, fake shippers, or other fraudulent or criminal conduct by users or third parties

  • seller refusal or cancellation of a sale

  • failed negotiations or missed deals

  • platform downtime, bugs, outages, or service interruptions

  • feature changes, removed tools, or discontinued services

  • hacking, phishing, malware, unauthorized access, or other security incidents

  • lost, corrupted, or unrecoverable data

  • translation errors or inaccurate automatically translated content

Account And Security

  • Users must keep their mailbox, devices, and login links secure.

  • Login links are personal and may be time-limited.

  • ArtListings may use security controls to protect platform access and integrity.
